The Education for Persons with Special Educational Needs Act, 2004 provides for the education of children under 18 with special educational needs. The Act focuses on children's education but there are references to further and adult education. The Act sets out a range of services to be provided to people with special educational needs. These include assessments, education plans and other support services. The Act has been passed but is not yet fully in effect.
The Education Act, 1998 places an obligation on education providers to implement the constitutional rights of children as they relate to education, and to make available to pupils a level and quality of education that meets their individual needs and abilities.
